Aged Care Costs terms

Version 2.

1. Who we are and these terms

This site is run by A.C.N. 662 869 614 Pty Ltd trading as Aged Care Costs (ABN 44 662 869 614) ("we", "us"; ACN 662 869 614), agedcarecosts.com. Contact: support@agedcarecosts.com, brucevr@yandex.com.

These terms apply when you use agedcarecosts.com, create an account, use the calculator or buy a report. By using the site, you agree to them. Our Privacy policy, Disclaimer and Refund policy also apply.

2. What we provide

  • A calculator that estimates aged care home fees, contributions and accommodation costs from the details you enter.
  • A paid family report: a written report setting out estimated costs and the options you choose to compare, such as keeping or selling a home, or paying by RAD, DAP or a combination.
  • Guides and general information about aged care costs.

3. General information only: not financial advice

  • Our calculator, reports and guides give general information and estimates only. They don't take into account your or your family's objectives, financial situation or needs, and they aren't financial product advice, tax advice, legal advice or a recommendation.
  • We don't hold an Australian financial services licence (AFSL), and we don't give personal financial advice. Where reports show several options, we don't rank them or tell you which to choose.
  • Estimates depend on the details you enter and on the government rates in force on the date shown in the estimate or report. Rates are indexed and rules change, so actual fees are set by Services Australia (or DVA) and your aged care provider, not by us.
  • Before making decisions, consider getting advice from a licensed financial adviser. Services Australia's free Financial Information Service can also help.

4. Your account

  • You sign in with a one-time link sent to your email. Please keep access to your email account secure.
  • Please give accurate information. Estimates are only as good as the details entered.
  • You must be 18 or over to buy a report.
  • You can ask us to close your account at any time, through our Contact page or by emailing support@agedcarecosts.com. We'll close it and delete your information, apart from records the law requires us to keep, such as tax invoices.

5. Acceptable use

Please don't misuse the site. That includes trying to break its security, scraping it, overloading it, using it for anything unlawful, or entering someone else's personal information without the right to do so. We may suspend accounts that do. Where the law requires, we'll give you notice and a refund of anything paid for services not provided.

6. Prices and payment

  • Prices are in Australian dollars and include GST. Each report's price is shown on the pricing page and at checkout. The price you pay is the one shown at checkout.
  • Payment is by card through Stripe. Every receipt is a tax invoice.

7. Delivery of reports

Your report is delivered in your account and by email, as a download link, within 15 minutes of your payment being confirmed. The end of that time is the delivery date used in section 8.

7.1 Free updated report (Full report only). If a government fee, Age Pension, deeming or interest rate that your report uses changes within 12 months of purchase, we'll send you an updated report at no cost. We make it after we publish the new official rates in our calculator, once the change has taken effect, so there's no fixed day. It's worked out automatically from the answers saved when you bought the report, without any changes, and it goes into your account (and by email, once we send report emails). It's a refreshed estimate, not a new review of your situation, and it covers rate changes only. A change in your parent's situation needs a new report. If you close your account or ask us to delete your information, the free updates stop.

8. Refunds (one policy everywhere: D7)

8.1 Full refund if we don't deliver on time. If we haven't delivered your report by the delivery date, we'll refund the full amount you paid without you needing to ask. If your report is late, we'll still send it to your account once it's ready, at no extra cost.

8.2 Refund on request before delivery. You can cancel your order and get a full refund at any time before your report is delivered, for any reason.

8.3 How to ask for a refund. Email support@agedcarecosts.com with the email address you used to order, or your order number. We don't need a reason.

8.4 How refunds are paid. We process refunds within 5 working days of your request (or of the delivery date, for a late report), to the original payment method. Your bank or card provider may take a few more days to show it.

8.5 After delivery. Once your report is delivered, sections 8.1 to 8.4 no longer apply. However, if the report has a problem (for example, it isn't what was described or has a significant error), contact us at support@agedcarecosts.com and we'll work with you to fix it or refund you, as the Australian Consumer Law requires.

8.6 Your consumer rights. See section 9.

9. Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). For example, services must be provided with due care and skill and be fit for any purpose you've told us about. For major failures with a service, you're entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You're also entitled to be compensated for any other reasonably foreseeable loss or damage. If a failure doesn't amount to a major failure, you're entitled to have problems with the service rectified in a reasonable time. If that's not done, you're entitled to cancel your contract and get a refund for the unused portion of the contract.

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the ACL or any other law that cannot be excluded.

10. Limits on our liability

10.1 Subject to section 9, and to the extent the law allows:

  • (a) we're not liable for loss arising from decisions you make using our estimates, reports or guides, given they're general information and depend on your inputs and on rates at a date;
  • (b) we're not liable for indirect or consequential loss; and
  • (c) our total liability to you for any claim about a report or the service is limited to the amount you paid us for it.

10.2 Where the ACL lets us limit our liability for failing to meet a consumer guarantee for services not of a kind ordinarily acquired for personal, domestic or household use, our liability is limited to supplying the services again or paying the cost of having them supplied again.

10.3 Nothing in this section limits liability that cannot lawfully be limited, including for our negligence causing personal injury or for fraud.

11. Our content

The site, calculator, reports and guides are our copyright or used under licence. You may download, print and share your own reports for your family's and your advisers' use. Please don't resell or republish them, or copy the guides, without our permission.

12. Third-party links and services

We link to government sites and may refer you to independent advisers. We aren't responsible for their content or services. Any adviser referral and any referral fee we receive will be disclosed to you before you're referred (see the Disclaimer).

13. Changes to these terms

We may update these terms. The version that applies to a purchase is the one in force when you paid. We'll tell you about material changes before they apply to your account.

14. Complaints

Please contact support@agedcarecosts.com first. We'll reply within 10 working days. You may also contact your state or territory consumer protection agency, for example Consumer Protection WA.

15. Governing law

These terms are governed by the laws of Western Australia. You and we submit to the non-exclusive jurisdiction of the courts of Western Australia and courts that can hear appeals from them. This doesn't affect any right you have to bring a claim in your own state or territory under consumer protection law.

16. Cookies and measuring tools

Our site uses our own visitor cookie, Google Analytics, Google Ads and Meta. On most pages they run from the first page you open, until you choose "No thanks" or switch them off in "Cookie settings". On the pages where you enter details about your parent's health and money (the calculator and your results, the walkthrough, checkout and your report pages), Google and Meta don't run until you choose "Allow". Every page and form works whichever you choose. If you choose "No thanks", the tools stop straight away; your choice is stored in the ac_consent cookie (12 months, strictly necessary). Our privacy policy (/au/privacy, section 3A) explains what the tools collect, what they never receive, and how you can limit them.

Google Analytics is linked to Google Ads to measure how our ads perform, so it counts as an advertising tool. Like the other tools, it runs from the first page you open (on the pages where you enter details, only after you choose "Allow") and stops if you choose "No thanks" or untick Advertising in "Cookie settings". Data already sent isn't recalled.
